By accessing and using Bleet ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Bleet is an AI-powered social media intelligence platform that analyzes your social media behavior, engagement patterns, and posting history to provide personalized suggestions for meaningful social media interactions. Our service is available through a web application and a native iOS app. Our service includes:

• Analysis of your social media posting patterns and preferences
• Curated feed of engagement opportunities from your timeline
• AI-generated suggestions for replies, quotes, and original posts
• Personalized recommendations based on your social media voice and goals
• Voice-to-post recording and transcription (iOS app)
• Smart queue scheduling for social media posts across platforms

3. User Accounts and Eligibility

To use Bleet, you must:

• Be at least 18 years old or have parental consent
• Create an account with accurate and complete information
• Connect at least one social media account (LinkedIn or X/Twitter)
• Maintain the security of your account credentials
• Comply with the terms of service of connected social media platforms
• Provide accurate information and update it as necessary
• If using the iOS app, have a compatible device running iOS 17.0 or later

4. Acceptable Use Policy

You agree to use Bleet responsibly and not to:

• Use the Service for any illegal, harmful, or unauthorized purpose
• Generate, post, or promote spam, harassment, hate speech, or harmful content
• Attempt to circumvent any limitations, access controls, or security measures
• Violate any applicable laws, regulations, or third-party rights
• Interfere with the proper functioning of the Service or other users' experience
• Impersonate others or misrepresent your identity or affiliation
• Use automated systems to access the Service without permission
• Reverse engineer, decompile, or attempt to extract source code

5. AI-Generated Content and Suggestions

Bleet uses artificial intelligence to generate content suggestions and recommendations. You acknowledge that:

• All AI-generated content is provided as suggestions only
• You are solely responsible for any content you post or publish
• Generated content should be reviewed and edited before posting
• Bleet is not liable for the content, consequences, or impact of AI suggestions
• You retain full ownership and responsibility for your social media content
• AI suggestions may not always be accurate, appropriate, or suitable

6. iOS Mobile Application

The Bleet iOS app is subject to these Terms in addition to the Apple Media Services Terms and Conditions. The following additional terms apply to your use of the iOS app:

• Device Permissions: The app requires access to your device's microphone to record voice notes for transcription. You may revoke this permission at any time through your device's Settings, though this will disable the voice recording functionality.
• Voice Recordings: Audio recorded through the app is uploaded to Bleet's servers and processed using third-party transcription services (OpenAI Whisper). You are responsible for ensuring that you have the right to record any audio content and that it does not violate the rights of third parties.
• Background Recording: The app may continue recording when in the background. It is your responsibility to be aware when recording is active.
• Network Requirements: The app requires an active internet connection to function. Features including authentication, transcription, post generation, and queue management all require communication with our servers.
• Third-Party Acknowledgment: Apple is not a party to these Terms and has no obligation to provide maintenance, support, or warranty for the app. Any claims relating to the app, including product liability, legal compliance, or intellectual property, are governed by these Terms and not by Apple.
• App Updates: We may release updates to the app from time to time. You are responsible for installing updates to ensure continued compatibility and access to new features and security patches.

7. Subscriptions and Payments

Access to Bleet's features requires an active subscription. The following terms apply:

• Free Trial: New users may be eligible for a free trial period. At the end of the trial, you must subscribe to continue using the Service.
• Payment Processing: All subscription payments are processed through Stripe. Bleet does not store your full credit card details. Subscriptions are managed through the Bleet web application, not through Apple's in-app purchase system.
• Billing and Renewal: Subscriptions renew automatically at the end of each billing period unless canceled. You may manage or cancel your subscription through the billing section of your account at app.getbleet.com.
• Refunds: Refund requests are handled on a case-by-case basis. Contact us at [email protected] for refund inquiries.
• Price Changes: We may modify subscription pricing with reasonable notice. Existing subscribers will be notified of any changes before their next billing cycle.

8. Data and Privacy

Your privacy is important to us. Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described in our Privacy Policy.

9. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Bleet and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.

10. Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We may also impose limits on certain features or restrict your access to parts or all of the Service without notice or liability.

11. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL BLEET BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

12. Indemnification

You agree to defend, indemnify, and hold harmless Bleet and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on our website and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
